Foreclosure Basics: What is a Foreclosure?

Foreclosure Definition: Simply stated, a foreclosure is the process followed by a lender when they force the sale of a piece of property to repay a borrower’s delinquent debt. During this forced sale, or “Foreclosure”, the bank must follow strict laws, adhere to statutory timelines, and complete certain tasks which together make up the 3 stages of foreclosure.  

The 3 Stages of Non-Judicial Foreclosure in California Are: 

  • Pre-Foreclosure (NOD) - This is when the bank has formally started the foreclosure process by filing a Notice of Default (NOD) with the county recorders office, and makes it public record. During this critical time the borrower and lender are both under tremendous pressure to work out the best solution possible for both sides. By law the NOD stage takes at least 3 months before the foreclosure can proceed.


  • Trustee Sale (NTS or NOS) - This is when the property is sold at auction to satisfy the delinquent debt. The borrower has until 5 days before the auction to bring the debt current, otherwise the property will be sold at the auction to the highest bidder. This stage takes at least 21 days to complete, and after 17 days, the bank is under no obligation to re-instate the loan even if they debt is made current.


  • Real Estate Owned (REO's) - Some properties are sold at auction to private parties that will either live in the home, fix and flip it for profit, or have some other investment strategy for that property. The homes that receive no bids, or have very little equity often times revert back to the banks. When this happens they are then referred to as Real Estate Owned. Banks are not in the business of owning real estate, and often times they need agents to list and sell these homes for them, or investors to make them any offer to take it off their hands.

Each of these 3 stages of foreclosure provide homeowners, investors, and industry professionals with lucrative opportunities. When executed correctly they can all offer tremendous profits, and are viable strategies to find the wealth and success you desire in any market.
